Terms of Service

1. What We Do

vibefly builds and hosts websites for small businesses. You provide us with the information and content for your site — your business details, copy, images, and preferences. We design, build, and host it for you.

2. Payments

Launch fee: You'll review and approve your finished site before we send an invoice. Because you've seen and signed off on the work, launch fees are non-refundable.

Monthly subscription: Hosting and ongoing AI-assisted edits are billed monthly. You can cancel at any time — no notice period required. Your service continues through the end of the current billing period, then ends. No partial refunds are issued for unused time.

Site availability: If your subscription ends or is canceled, your site will be taken down at the close of the billing period. Your content will not be retained after that point.

3. Your Responsibilities

You're responsible for the accuracy and legality of the content you provide. Don't send us anything you don't have the right to use. By giving us your content, you confirm you have permission to use it.

4. AI-Generated Content

vibefly uses AI tools to assist in generating website copy, structure, and content suggestions. All AI-generated content is reviewed and delivered to you as part of our service. You are responsible for reviewing that content for accuracy, appropriateness, and compliance with applicable laws before your site goes live. By approving your site, you accept responsibility for the content it contains.

5. Our Work

We retain the right to display completed sites in our portfolio and for promotional purposes. If you'd prefer we not showcase your site, just let us know and we'll honor that request.

6. Limitation of Liability

vibefly.ai and motiveFx LLC are not liable for indirect, incidental, or consequential damages — including lost revenue or data — arising from use of our services. Our total liability in any dispute is limited to the amount you paid us in the 30 days preceding the claim.

7. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes are posted means you accept the updated terms.

8. Domain Registration and Ownership

When you purchase domain registration through vibefly.ai, the domain is registered using your name and contact information — you are the rightful owner. The domain is held and managed in our Cloudflare account on your behalf for the duration of your service.

WHOIS privacy protection is always enabled at no additional charge. Your personal contact information will not appear in public domain records.

If your subscription ends or you request a transfer, we will initiate a domain transfer to the registrar of your choice within 5 business days of receiving your request or final billing period end. You are responsible for providing a valid transfer destination. We will hold the domain for up to 90 days after service ends while awaiting transfer instructions. After 90 days, we reserve the right to release or let the domain expire if no transfer has been completed.

You are responsible for any transfer fees charged by the receiving registrar. We do not charge a transfer fee.

9. Indemnification

You agree to indemnify and hold harmless vibefly.ai and motiveFx LLC, its officers, employees, and agents, from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or relating to: (a) the content you provide for your website, (b) your use of our services, (c) your violation of these Terms, or (d) any claim that your content infringes the intellectual property or other rights of a third party.

10. Accessibility

vibefly.ai builds websites using modern, semantic HTML and follows general web best practices. However, we do not guarantee that any website we build will comply with the Americans with Disabilities Act (ADA), Web Content Accessibility Guidelines (WCAG), or any other accessibility standard or regulation.

You are responsible for ensuring that your website meets any accessibility requirements applicable to your business. If you have specific accessibility requirements, please let us know before work begins and we will do our best to accommodate them.

11. Force Majeure

vibefly.ai and motiveFx LLC are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to internet or infrastructure outages, third-party service failures (including Cloudflare, AWS, or other providers), natural disasters, acts of government, or other events outside our control.

12. Dispute Resolution

We'd rather resolve any issue quickly and directly. If you have a concern, please contact us at info@vibefly.ai first and give us a reasonable opportunity to address it.

If a dispute cannot be resolved informally, it will be subject to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Connecticut. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

13. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles.
